Hotel Terms and Conditions

1. Purpose

These general terms and conditions of sale (hereinafter referred to as “T”) aim to define the terms of booking, payment, and cancellation, as well as the rights and obligations of guests of the “Alliance Hotel”, operated by SAS Cinépole, located at 8 Avenue des Platanes, 94340 Joinville-le-Pont and registered with the Créteil Trade and Companies Register under number RCS 379 062 763.

They apply to all services provided by the Hotel, whether booked directly by an individual or through commercial partners (travel agencies, online booking platforms, etc.). Any booking implies full and unreserved acceptance of these T, which take precedence over any other document, unless otherwise expressly agreed in writing with the Hotel management.

2. Reservations

Reservations can be made by phone, email, on the Hotel’s official website, or through approved partner distributors (such as Booking.com, Expedia, HotelBeds, etc.).

To be valid, a reservation must be guaranteed. The guarantee can take the form of a valid credit card number (including the expiration date and security code) or a deposit payment amounting to 30% of the total stay. In the absence of a guarantee, the Hotel reserves the right to refuse the reservation.

For reservations made for groups or companies, it is up to the Hotel management to define the amount of the deposit corresponding to the reservation based on discretionary criteria (group size, number of rooms booked, commercial relationships established with a partner, etc.).

The reservation becomes firm and definitive only upon written confirmation sent by the Hotel to the guest (by email or postal mail). This confirmation specifies, in particular, the dates of the stay, the type of room booked, the number of people, and the applicable rate.

All reservations are personal and cannot be transferred to a third party without prior notification to the establishment and its written consent.

3. Pricing Conditions

The rates communicated by the Hotel are expressed in euros (€) and are inclusive of all taxes (TTC), excluding the tourist tax, which is collected on behalf of the local authority and must be paid separately during the stay.

Rates are subject to change at any time, without prior notice, depending on the Hotel’s commercial policy and economic conditions. However, the rate applicable to the guest is the one confirmed at the time of booking and mentioned in the written confirmation sent by the Hotel.

Rates may vary depending on the period, room type, number of people, and associated services (breakfast, etc.). Certain additional services (parking, room service, pets, etc.) may incur extra charges not included in the basic room rate.

4. Payment Methods

Payment for the stay can be made by credit card (Visa, Mastercard, American Express, etc.), by prior bank transfer, in cash within legal limits, or by any other payment method accepted by the Hotel.

The balance of the stay must be paid no later than the day of departure, unless specific conditions are stipulated in the rate offer (e.g., non-refundable rates requiring full payment at the time of booking).

In case of non-payment of the outstanding balance by the guest, the Hotel reserves the right to charge late payment penalties equivalent to the increased legal interest rate, as well as any collection fees.

The increased rate applies if payment is not made within 2 months following the due date or formal notice. It corresponds to the simple legal rate increased by 5 points. It is 8.71% for debts owed by professionals (3.71% + 5 pts).

5. Cancellation and Modification Conditions

5.1 Cancellation by the Guest

Any cancellation must be notified in writing (email or registered mail). The following conditions apply depending on the reservation made, unless otherwise specified in the booking confirmation:

  • Free cancellation possible up to 3 days/hours before the scheduled arrival date.
  • In case of late cancellation (after the aforementioned deadline), fees equivalent to 30% of the total stay amount will be charged.
  • In case of non-arrival (“no-show”), the Hotel reserves the right to charge the full amount of the reserved stay or, at minimum, the first night.

5.2 Modification of Stay

Any request to modify the dates, room type, or duration of the stay must be submitted for the Hotel’s approval. In case of unavailability or impossibility of modification, the initial cancellation conditions will apply.

5.3 Cancellation by the Hotel

In case of force majeure, unforeseen event, or material impossibility to honor the reservation, the Hotel reserves the right to cancel the reservation. In this case, the guest will be immediately informed and offered, if possible, an alternative accommodation solution in an establishment of equivalent or superior category, or a full refund of the amounts already paid, without any other compensation being claimable.

6. Arrival and Departure

Rooms are available from 2:30 PM on the day of arrival and must be vacated by 11:30 AM on the day of departure.

In case of early arrival or late departure, the guest must make a prior request to the reception. The Hotel is not obliged to grant it and may charge additional fees corresponding to €15 for an early arrival or late departure.

7. Guest Obligations

The guest undertakes to use the room and Hotel facilities peacefully, to respect the internal regulations, and to behave in a manner consistent with good morals and the tranquility of the establishment.

It is forbidden to bring undeclared external persons into the room, unless with prior written agreement from the management.

The Hotel is a non-smoking establishment in its rooms and indoor areas, unless otherwise clearly indicated. Any breach of this rule may result in a flat-rate charge for restoration and deep cleaning.

Any damage caused to the Hotel’s premises, furniture, equipment, or facilities will be financially charged to the responsible guest via the security deposit paid at the beginning of the stay.

The guest must ensure that their children and dependents also comply with these obligations.

8. Liability

The Hotel disclaims all responsibility for the loss, theft, or damage of personal belongings left unattended in the room or common areas. It is recommended to use the safe provided, the operation of which will be explained to guests by the establishment’s receptionists.

The Hotel’s liability cannot be engaged in case of misuse of the facilities by the guest, nor in case of disruptions related to external events beyond its control (power outages, water failures, internet interruptions, external noise disturbances, etc.).

Any complaint regarding theft or damage must be immediately reported to the reception, which reserves the right to take action.

9. Pets

Pets are accepted in the establishment subject to prior declaration at the time of booking. A flat rate of €15 per night per animal is applied to cover additional cleaning and disinfection costs.

Pets remain under the full responsibility of their owner and must be kept on a leash in all common areas. Their presence is not allowed in dining areas, with the exception of those provided by law (guide dogs for the blind or assistance dogs).

In case of an undeclared animal upon arrival, the Hotel reserves the right to immediately demand payment of the pet fee. If the guest refuses to pay this supplement, their reservation will be considered cancelled by them, and the cancellation conditions provided in Article 5 will automatically apply.

10. Force Majeure

Neither party shall be held liable for a breach of its contractual obligations if it results from an event constituting force majeure, as defined by Article 1218 of the Civil Code and current case law.

Specifically considered and recognized by consistent case law as cases of force majeure are: natural disasters, fires, epidemics, pandemics, terrorist acts, wars, strikes, blockages of means

of transport or unforeseen material impossibilities rendering the performance of obligations impossible.

11. Personal Data

As part of the booking and stay, the Hotel collects certain personal data from the guest (name, personal contact details, banking information). This data is necessary for processing the reservation and is processed in accordance with the General Data Protection Regulation (GDPR) as defined and governed by European Union law.

The guest has a right to access, rectify, limit, and delete their personal data. Any request must be sent by email to the establishment’s reception, indicated below: [email protected].

This data is only communicated to third parties insofar as it is necessary for the smooth running of the stay or the management of the commercial relationship.

12. Complaints

Any complaint regarding the stay must be made in writing and addressed to the Hotel management by postal mail at 8 Avenue des Platanes, 94340 Joinville-le-Pont or by email at [email protected], within a maximum period of 30 days following the end of the stay.

The Hotel undertakes to acknowledge receipt of the complaint and to respond within a reasonable timeframe.

In case of persistent dispute, the guest may resort to a consumer mediator free of charge, in accordance with the provisions of the Consumer Code. The contact details of the competent mediator will be provided upon simple request.

13. Applicable Law and Competent Jurisdiction

These T are governed by French and European law. Any dispute relating to their validity, interpretation, or execution falls under the exclusive jurisdiction of the courts of Joinville-le-Pont, unless mandatory legal or contractual provisions state otherwise.
